Kevin Casey has counseled clients for more than 25 years in all aspects of the intellectual property field, encompassing patent, trademark, copyright, trade secret and related matters.

In today’s market, the IP of a business is often the predominant asset. Indeed, in many mergers, acquisitions, asset sales, or other business and financial transactions, there may be no physical assets to be transferred; the value of a company may be in the technical know-how, the principal inventors, software, a Web site, a method of doing business, or even a client listing. Therefore, when entering into a potential deal involving the transfer of IP assets, all parties need to undertake a due diligence analysis in order to best equip themselves with the necessary and appropriate information about the IP assets at issue. Mr. Casey brings the combination of his valuable IP and business experience to assist in that critical due diligence analysis. He understands the transaction; gathers all relevant information; reviews and analyzes that information; identifies and, if possible, corrects risk areas relating to the IP assets; and identifies and addresses future or post-closing risk areas.

Mr. Casey has an active trademark practice and has supported patent procurement, including U.S. and international patent application preparation and prosecution, with respect to a wide variety of technologies. Specifically, he has written and supervised the writing of hundreds of patents involving mechanical devices of all types with an emphasis on medical products, semiconductors and materials applications.

Mr. Casey has provided IP legal opinions on patent infringement and right-to-use, patent validity, patentability, trademark right-to-use and right-to-register, trademark dilution, domain name, copyright and others. Mr. Casey also has extensive experience negotiating and completing IP licenses. As co-chair of the firm’s IP Litigation Practice Group, he has acted as lead litigation counsel and participated as assistant counsel in more than 50 IP cases. He also has an active appellate practice before the U.S. Court of Appeals for the Federal Circuit, applying his experience as a judicial clerk to the Hon. Helen W. Nies, former Chief Judge on the Federal Circuit.

As a member of the firm’s Alternative Dispute Resolution (ADR) Practice Group, Mr. Casey considers ADR to be an integral part of his practice. He has participated in various ADR procedures as a party representative and as a neutral. Mr. Casey has been certified as both an arbitrator and a mediator by the U.S. District Court for the Eastern District of Pennsylvania. He has also assisted District Court judges as a Special Master. A member of the Mediation Task Force of the International Institute for Conflict Prevention and Resolution, Mr. Casey served as the chair of the mediation subcommittee and collaborated on the task force’s report, titled “Effective Practices Protocol for Mediation of Patent Disputes.”

Mr. Casey has authored numerous papers on IP issues, and has been an adjunct professor at Temple University Beasley School of Law since 1995. He is ranked as one of the leading IP attorneys in Pennsylvania by “America’s Leading Lawyers for Business, The Client’s Guide” and has been consistently named a Pennsylvania Super Lawyer® by a vote of his peers. Mr. Casey was included consecutively since 2007 in the editions of The Best Lawyers in America, regarded as a definitive guide to legal excellence in the United States. He was named the Best Lawyers’ 2012 and 2010 Philadelphia Area Intellectual Property “Lawyer of the Year,” an honor only one lawyer in each specialty in each community receives. Selection for Best Lawyers is based on a peer-review survey in which more than 1.8 million individual evaluations are reviewed. In addition, he was recommended as a leader in intellectual property in Pennsylvania in the 2014, 2013, 2012, 2011, 2010, 2009 and 2008 editions of Chambers USA: America’s Leading Lawyers for Business, where he was recognized as “a bright attorney who is right on the ball” and noted for having a "very strong reputation for being an excellent IP attorney." He was also recognized as a preeminent AV-rated attorney by Martindale-Hubbell.


Before embarking on his legal career, Mr. Casey worked as an engineer with General Electric for four years. An avid baseball and ice hockey fan, he continues to play both sports. Mr. Casey participated in the 2008 Mets Fantasy Camp in Port St. Lucie, Florida.

He is proud of his daughter, a musical theater graduate (Tisch School) from New York University and an MSW graduate from the University of Texas at Austin, and his son, an engineering graduate from Lafayette College.
