Andy Levine handles a variety of environmental transactional, regulatory, enforcement and litigation matters. He provides extensive counsel on statutory and regulatory developments in the energy, solid waste, land development, water and air programs of several states and frequently assists major companies in developing compliance programs that carefully coordinate both regulatory systems and bottom-line productivity.
Mr. Levine’s practice concentrates on working with large-scale developers and investors on a variety of energy-related projects throughout the mid-Atlantic region, including CHP plants, large-scale energy efficiency and renewable power and chemical projects, pipeline development and landfill gas facilities.
Mr. Levine takes a strategic approach to environmental transactions, and concentrates on exploiting the advantages posed by seemingly restrictive laws and liabilities. This approach has led to many projects designed to help industries rethink their waste as a product to be used for renewable energy, or other commercially viable end uses. Most recently, Mr. Levine worked to revise a bill in Delaware to ensure that draconian setback requirements for energy production facilities specifically exempted or grandfathered projects using renewable energy. In connection with this legislative process, Mr. Levine obtained the support of various national environmental organizations, which provided lobbying and testimonial support. He also works closely with insurers to transfer risk from clients in a transactional setting.
Mr. Levine’s significant projects include:
- negotiation of large-scale oil and gas leases on behalf of institutional land holding companies
- being appointed counsel to a confidential state government agency investigation relating to donation of rail cars contaminated with high levels of PCBs
- initiating the alternative energy pipeline from a landfill to a chemical plant to displace traditional fuels at the plant, eliminate significant landfill emissions, and provide revenue stream and tax credits for beneficial use of previously flared gas
- overseeing the redevelopment and refinancing for a large aerospace and satellite testing facility for reuse as a large office complex under the New Jersey Brownfields Program
- acting as redevelopment counsel to a confidential client for the proposed reuse of a Pennsylvania HSCA site as a large regional health care facility for elderly
- representing a client in the purchase of a BRAC facility, obtaining ground and air development rights at a closed military facility with agreement by the Army to remediate, and with prospective purchaser agreement for client
- acting as counsel and project manager of voluntary drinking-water-quality investigations for a large, multi-jurisdictional school system, involving more than 250 institutions, to detect lead and remediate causes of exposure to students and staff
- acting as counsel for a chemical company seeking to sell its headquarters facility, which was also a superfund site
Consecutively since 2008, Mr. Levine has been included in The Best Lawyers in America, regarded as a definitive guide to legal excellence in the United States. PERSONAL
Before his career at Stradley Ronon, Mr. Levine was senior environmental counsel and assistant general counsel for Waste Management, Inc.; senior assistant regional counsel at EPA Region III; as well as a special assistant U.S. attorney for the Eastern District of Pennsylvania. In this latter capacity, former Attorney General Thornburgh awarded him with a special commendation for outstanding performance in connection with a benzene National Emission Standards for Hazardous Air Pollutants (NESHAP) enforcement matters. Most recently, one of Mr. Levine’s renewable energy projects was awarded the Governor of Pennsylvania Award for Environmental Excellence. |
