Contractual Liability and Additional Insured Provisions

Course Description: Contracts frequently include clauses in which Party A assumes the legal liability of Party B for damages arising from activities outlined in the contract. Even with contractual liability insurance coverage, a company that has assumed the liability of another may be forced to finance some of the transfer with its own assets. Furthermore, since Additional Insureds are given access to the named insured’s policy limits for both defense and settlement, adding an Additional Insured to the policy can adversely affect the insured’s loss experience. The course will review the contractual liability insurance available under the general liability policy and the protection which can be granted to Additional Insureds. The course will also address the necessity to limit assumed contractual liability and explain how to structure the scope of coverage afforded to Additional Insureds.
