Flying High: Arbitration Win for Airframe Structures Manufacturer

Successfully represented a designer/manufacturer of major airframe structures for prime aircraft manufacturers in an international arbitration with its foreign airplane assemblies supplier over payments withheld from supplier based on poor performance. Defeated all contested claims, including supplier’s demand for payment of unsupported portion of invoices; and claims for tooling rework; scrapped material; idle staff and floor space; wrongful termination of one of the manufacturing packages; and breach of the duty of good faith and fair dealing, and recovered on counterclaims for cover costs for reworking and finishing defective products; overtime costs; and the costs of air shipping late parts from foreign supplier to U.S. client.
