Overview

Michael Cordone has, for more than 20 years, focused upon bankruptcy, workout, receiverships and creditors’ rights issues and litigation. He regularly represents banks, mutual funds, receivers and other creditors seeking to maximize their recoveries and minimize liability from “clawback” and avoidance claims in bankruptcy and Ponzi scheme cases. He is experienced in a wide array of industries, including manufacturing, investment, brokerage, health care, retail, energy, franchising and real estate. Additionally, Mike has particular experience with complex derivative and commodity trading issues and in uncovering and addressing fraudulent activity in Ponzi and other cases.

  • represented numerous large mutual funds in successfully resolving broken trades, terminating swaps and other derivative products and the resulting claims and liabilities in the Lehman Brothers and MF Global bankruptcy cases
  • represented several of the largest energy suppliers and sellers with regard to the bankruptcy issues of their customers
  • represented a federal receiver overseeing a group of commodity hedge funds operated as a Ponzi scheme, successfully recovering and distributing more than $160 million to the investors. The representation included litigation in the U.S., Canada and the Cayman Islands
  • counseled a large national bank in the restructuring and successful workout of multiple loans to affiliated international corporations
  • represented a large real estate trust and national banks in bankruptcy cases filed by national retailers
  • defended a large national bank in responsible personal-tax liability litigation arising out of a workout and receivership
  • represented several regional lenders in connection with the workout and bankruptcies of various health care institutions
  • defended multiple individuals and institutions against “clawback” claims asserted by the receiver in the Joseph Forte L.P. Ponzi scheme case
  • represented a large national bank in the workout, foreclosure and re-sale of numerous commercial properties owned by a group of related borrowers
