Overview

Lee Rosengard has been a commercial litigator for more than 35 years. He is chair of the ADR practice group and is former chair of the litigation practice group. He is a member of the CPR Institute Panel of Distinguished Neutrals and the American Arbitration Association Commercial Panel and Large Complex Case Panel, and also serves as a Judge Pro Tempore for the Philadelphia Court of Common Pleas Commerce Program.

Lee is an active member of the Philadelphia Bar Association’s Alternative Dispute Resolution Committee, which he previously chaired. He is a Lecturer in Law of the faculty of both the University of Pennsylvania Law School and Villanova University School of Law and a frequent guest lecturer on ADR at area law schools.

Representative Matters

  • successfully represented a designer/manufacturer of major airframe structures for prime aircraft manufacturers in an international arbitration with its foreign airplane assemblies supplier over payments withheld from supplier based on poor performance. Defeated all contested claims, including supplier’s demand for payment of unsupported portion of invoices; and claims for tooling rework; scrapped material; idle staff and floor space; wrongful termination of one of the manufacturing packages; and breach of the duty of good faith and fair dealing, and recovered on counterclaims for cover costs for reworking and finishing defective products; overtime costs; and the costs of air shipping late parts from foreign supplier to U.S. client
  • represented a major U.S. aerostructures conglomerate against an Asian supplier of airplane structures in the International Court of Arbitration of the International Chamber of Commerce
  • represented an architecture and design firm and its executive at the trial court and appellate level, resulting in the affirmance of the trial court’s narrowing of a non-competition covenant in an agreement between an architect and his former partner
  • represented a joint venture between an Australian company and a Bolivian company against a sister corporation to the Bolivian participant in the joint venture in an arbitration pending before the International Centre for Dispute Resolution
  • represented the Commissioners of a Pennsylvania state licensing board and its general counsel and executive director in the District Court and the U.S. Court of Appeals for the Third Circuit, resulting in the affirmance of the dismissal, on the grounds of quasi-judicial immunity, of claims brought by two plaintiffs who alleged they were wronged in the board's licensing process
  • served as sole arbitrator in cases relating to the decisions of two large automobile manufacturers to terminate franchises across the country in the wake of their separate filings for bankruptcy relief
  • served as sole arbitrator in a dispute between parties to a limited partnership agreement over whether the governing limited partnership agreement entitled the claimant partnership to inspect and copy certain documents in the possession of the respondent general partner
