Overview

Gina Stowe is a trial lawyer who handles a broad spectrum of complex civil litigation in both federal and state courts. Gina has a strong focus on insurance law and represents property and casualty insurers in commercial and property line coverage disputes. She also represents health, disability and long-term care insurers in claims disputes, provider reimbursement disputes, ERISA matters and class actions. In addition, she represents lenders and servicers in a wide variety of mortgage and lending disputes, such as residential and commercial foreclosures and cases arising under consumer protection and unfair trade practice laws. Gina also routinely represents clients in sophisticated business disputes, such as antitrust, intellectual property and securities fraud matters, as well as products liability, mass tort, medical malpractice and catastrophic personal injury matters.

Gina’s current engagements include, among others, the representation of a managed care organization in a class action brought by ambulance providers alleging improper reimbursement; the defense of a manufacturer in a products liability action brought by a plaintiff who suffered a catastrophic injury while operating a machine manufactured by the defendant; the prosecution of a patent infringement action against a leading telecommunications provider in connection with the alleged infringement of a patented calling card technology; and the representation of a nationally appointed write-your-own insurance company in claims brought under the National Flood Insurance Program.

  • defended a managed care organization in dozens of evidentiary hearings involving challenges to due process and medical necessity determinations underlying the denial or reduction of Medicaid benefits
  • obtained verdicts and summary dispositions in favor of lending institutions in numerous foreclosure and consumer protection matters
  • participated in the representation of a court-appointed receiver in a hedge fund fraud case that resulted in a recovery in excess of $75 million, including briefing complex RICO issues that defeated dispositive motions challenging the receiver’s RICO claims
  • defended a patent infringement action against a company that resulted in a multimillion dollar settlement to the defendant on a counterclaim, despite the plaintiff’s initial demand in excess of $2 million
  • handled a price-fixing antitrust claim on behalf of a medical device distributor against a manufacturer that resulted in a multimillion dollar settlement to the distributor
  • defended a religious institution in a variety of personal injury matters that resulted in numerous defense verdicts
