Stradley Secures Appellate Win for CNA Insurance

Stradley Ronon attorneys Steven Davis and Karl Myers won a decisive appellate victory in the Pennsylvania Superior Court, which upheld the dismissal of a plaintiff’s complaint seeking underinsured motorist benefits under a fleet insurance policy issued by National Fire Insurance Co., a CNA Insurance company. The plaintiff’s employer had informed National Fire it was waiving that coverage, and did not pay a premium for it. But the employer did not notify the plaintiff of the waiver, causing the plaintiff to claim public policy mandated his entitlement to those benefits after he was injured in an accident. The Superior Court’s decision is expected to have major ramifications, as it will impact many similar cases across the Commonwealth of Pennsylvania. Davis and Myers were engaged by CNA to handle the appeal and collaborated on the brief. Myers argued the case before the appellate court’s three-judge panel.
