The Supreme Court has unanimously held that a religious organization cannot be subjected to liability under state and federal workplace laws with respect to those persons who occupy positions of ministry. But the burden of proof is on the religious organization to demonstrate its entitlement to the immunity, called the “ministerial exception.” This webinar, by leading church-state lawyers, will explore the roots of the “ministerial exception” and the practicalities of administering and defending a religious institution’s personnel practices.
