Law360 regarding the Pennsylvania Supreme Court’s unanimous ruling in the
Sernovitz case, which upheld the constitutionality of the Pa. General Assembly’s Act 47 of 1988 and precluded belated procedural constitutional challenges to earlier legislative enactments. The articles discussed the Supreme Court’s reversal of a prior Superior Court ruling. Myers argued the case before the Supreme Court.
"The General Assembly is very pleased with the result and it is of significant institutional
interest to the legislature to be able to protect laws enacted many years ago from stale
lawsuits," said Karl Myers of Stradley Ronon Stevens & Young, who represented the
General Assembly, a cross-appellant.
