PHILADELPHIA – Stradley Ronon Partners David Franceski Jr. and Jeffrey McFadden, alongside Brinker Capital Vice Chairman John Coyne, presented “Advising Seniors: Providing Financial Guidance in the Face of Diminished Capacity and Other Senior-Related Issues,” in a webinar hosted by the Financial Services Institute. The webinar covered the legal and compliance challenges facing brokers and financial advisers dealing with seniors, potential scenarios that financial professionals may face with older investors, and evolving industry rules, regulations and firm best practices for effectively handling senior issues such as diminishing financial capacity and elder financial abuse. The webinar reviewed the law of incompetency and financial incapacity, adviser fiduciary duty and applicable Financial Industry Regulatory Authority existing and proposed rules and regulations.

Franceski concentrates his practice on complex commercial and securities litigation, primarily defending and counseling the firm’s top investment banking, broker/dealer and investment advisory clients. With over 35 years of trial, appellate, arbitration and regulatory enforcement experience, he has represented the country’s leading national, regional and local financial firms, including many of Wall Street’s major banks and broker/dealers. Franceski has a thorough understanding of virtually all financial investment products, including stocks, bonds, commodities, mutual funds, unit investment trusts, auction rate and mortgage-backed securities, non-traded REITS, structured notes and other alternative investments.

A partner in Stradley Ronon’s Washington, D.C., office, McFadden is a veteran trial, appellate and enforcement lawyer with nearly 25 years of experience litigating cases in state and federal courts and administrative forums across the country. He represents corporations and individuals in high-stakes civil and criminal litigation, administrative enforcement matters, and arbitrations.
