New DOL Overtime Rule Delayed By Federal Judge

As previously reported, a new federal overtime rule increasing the salary minimum for overtime-exempt employees was set to go into effect December 1, 2016. A federal judge has just issued a nationwide preliminary injunction blocking the Department of Labor from implementing and enforcing the new overtime rule until further court action. The full text of the Order is available here. It is not known at this time what impact further legal or legislative action will have on the new rule's effective date or implementation.

Employers who have made or intend to make compensation adjustments in connection with the new overtime rule should discuss the effect of the Order with management personnel and legal counsel.
