Daniel Pereira concentrates his practice on business bankruptcies, receiverships and other insolvency-related issues. Daniel prides himself on his ability to develop practical but effective strategies to address all facets of his clients’ needs with an eye toward maximizing value. Daniel’s practice spans both transactional and litigation matters and he regularly appears in federal and state court proceedings.
Although Daniel primarily focuses his practice on representing creditors, he also has experience representing debtors and other interested parties, including receivers, governmental entities and foreign debtors in cases arising under Chapter 15 of the U.S. Bankruptcy Code.
Among other clients, Daniel has represented banks and other lending institutions, trade vendors, service providers, commercial landlords and tort claimants. He has appeared in numerous state and federal courts pursuing loan enforcement actions, receiverships and commercial foreclosures; defending and prosecuting preference and fraudulent transfer claims; and handling various other commercial litigation matters in addition to handling out-of-court workouts.
Daniel has developed a comprehensive knowledge of the U.S. Bankruptcy Code, which allows him to quickly identify potential strategies and pitfalls. In addition to his extensive knowledge of the bankruptcy courts and other federal courts, Daniel is well-versed in various state court procedures, regularly appearing in the state courts of Pennsylvania, New Jersey, Delaware and New York, among others.

Successfully obtained court approval of a receivership sale of a 360-unit senior housing complex.
Successfully completed a receivership action in Philadelphia involving sales of three separate commercial properties.
Handled New York state court foreclosure and receivership action resulting in the sale of a vacant hospital in western New York.
Represented a national banking association in connection with the restructuring of an $18 million municipal bond facility and related credit facilities.
Counsel to a national banking association in receivership action involving a stalled construction project on a historic Philadelphia high-rise apartment building.
Represents a leading global e-commerce company in numerous retailer bankruptcy matters.
Developed creative strategy for addressing a recalcitrant debtor, which included the preparation and filing of a competing Chapter 11 plan on behalf of the debtor’s secured creditor, resulting in a favorable settlement for the creditor.
Successfully defended a client against a $14 million fraudulent transfer claim arising from a debtor Ponzi scheme, obtaining summary judgment in full in the client’s favor in district court.
Obtained denial of motion for preliminary injunction and temporary restraining order on behalf of a client accused of RICO violations.
Represented approximately 140 former employees of a national nutrition company relating to employment law claims in federal court litigation and employer’s Chapter 7 bankruptcy case.
On behalf of a receivables merchant, obtained judgment of non-dischargeability pursuant to Section 523 of the Bankruptcy Code with respect to debt of a Chapter 7 debtor of more than $20 million.
Successfully briefed and argued a motion to dismiss a commercial Chapter 7 bankruptcy case in order to permit the client to continue pursuing federal court litigation against the debtor’s principals.
Negotiated the private sale of a vacant retail property on behalf of a court-appointed receiver.
Pursued breach of contract claims against a purchaser of a national online clothing retailer that resulted in a favorable settlement for the client.
Represented a nonprofit nursing home operator as a debtor under Chapter 11, successfully obtaining approval of a sale of the debtor’s assets and confirmation of its Chapter 11 plan.
Community Impact
Daniel is an active member of the community and serves as a member of the Board of Trustees of Wissahickon Charter School, a K-8 tuition-free public charter school with two campuses located in Philadelphia. Daniel has also served as a voluntary attorney with the Support Center for Child Advocates for the entirety of his career, where he has represented the interests of numerous neglected and abused children in Philadelphia family court.
