Having successfully tried dozens of matters to verdict, Daniel Fitch is fluent in litigating cases in federal and state courts across the United States on behalf of large and small corporations. In addition to his litigation practice, Dan serves as the firm’s general counsel, providing guidance to the firm’s lawyers and business professionals on risk management and professional responsibility issues.
Dan manages all aspects of commercial litigation matters, including pre-litigation consultation and advice, evaluation of disputes pending in court or arbitration, and the litigation or arbitration process. Clients rely on Dan for his strategic guidance and pragmatic approach in obtaining the optimal conflict resolution.
His experience encompasses coverage disputes, including class actions and bad faith claim disputes, on behalf of insurance companies, as well as claims involving the National Flood Insurance Program. Dan also handles disputes for fidelity and surety companies.
Dan has extensive know-how in handling products liability claims, including toxic tort and manufacturing and pharmaceutical drug claims, with successful results in multiple state and federal court trials. This experience extends to the management and defense of mass tort litigation matters involving hundreds of individual plaintiffs.

Obtained a verdict in favor of an insurance company client following a jury trial as to whether an exclusion for asbestos claims was void as a matter of public policy.
Obtained multiple defense verdicts following jury trials in mass tort actions involving toxic torts, pharmaceuticals and medical devices.
Obtained the dismissal of a class action against a large broker-dealer, alleging improper handling of account assets, following class certification hearing.
Defended a large bank in several actions involving claims of forged checks, receiving a favorable opinion from a Pennsylvania appellate court in a case of first impression regarding the accrual of the statute of limitations under the revised Uniform Commercial Code.
Obtained the denial of class certification in an action asserting abuse and deficient education claims.
Obtained the dismissal of a class action following a class certification trial against a large insurance company, where it was alleged that homeowners’ insurance policies required the payment of general contractor overhead and profit regardless of whether such services were required.
Obtained summary judgment in favor of an insurance company client on breach of contract and bad faith claims involving a fire loss in northeastern Pennsylvania.
