David D. Piper

Overview

David Piper leverages over two decades of experience to advise individuals and global companies in commercial disputes, securities arbitration proceedings, privacy and cybersecurity matters, residential and commercial real estate issues, and all aspects of bankruptcy and insolvency. He works closely with clients to understand their businesses from the inside out and create innovative solutions to problems that align with their objectives. David’s broad practice helps him develop case strategy early, evaluate issues and value claims and, most importantly, helps his clients avoid litigation if possible — but vigorously pursue it if unavoidable.

David routinely represents investment banks, broker-dealers and registered representatives in claims related to unfair business practices, suitability, breach of fiduciary duty and Rule 10b-5 violations. He is well versed in matters related to exchange-traded funds, municipal bonds, private equity, initial public offerings, secondary offerings and private investment in public equity (PIPE) transactions.

David regularly represents residential and commercial lenders and servicers in disputes over individual lending transactions, origination and servicing, wrongful foreclosure, fraud, dual tracking, unfair business practices, loan modification, boundary line disputes, lien priority and misapplication of payments. He is well versed in defending clients against alleged violations of the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Truth in Lending Act and Real Estate Settlement Procedures Act.

David rounds out his litigation practice by handling a variety of commercial and real estate litigation matters. He represents financial services firms, manufacturers, retailers, and real estate owners and developers in connection with governmental claims, class action lawsuits, business-to-business disputes and common law claims.

In addition to his litigation practice, David counsels clients in connection with procurement and commercial contracting. David also regularly advises clients on data security and privacy law compliance, with the development of privacy policies and procedures, and with the implementation of security incident and response plans.

David is a Certified Information Privacy Professional/United States (CIPP/US).
