Trump Signs Executive Order Opening Door to PE in 401(k)s

President Trump has signed an executive order potentially opening the door for private equity and alternative investments — including crypto — to be included in 401(k) plans. This move could expand access to private markets within defined contribution plans, reshaping retirement investment opportunities.
“ERISA does not prohibit a plan from investing in private market assets or any other assets,” managing counsel Katrina Berishaj, chair of Stradley Ronon’s ERISA and employee benefits practice, told Citywire in July. “The fundamental legal question with respect to any investment made by an ERISA plan is whether the fiduciaries acted prudently and loyally in selecting and monitoring the investment.”
