The Influence of the Restatements in the Courts and State Legislatures

What has been the influence of the ALI’s Restatement of the Law, Liability Insurance in the four years since it was published, in 2019? Has it had influence in the courts and state legislatures? If so, what has the influence been, and how has the Restatement been received? Is the history of its drafting important today? While the ALI does not have another insurance Restatement in the works, it has been addressing select other insurance issues. The most prominent example is Section 20A of the ALI’s emerging Restatement of the Law (Third), Torts which addresses first-party insurance bad faith. What issues might Section 20A present for coverage counsel and their clients in the future? The panel will address these questions and related issues from the perspectives of policyholder counsel and insurance company counsel.
