Ethan Scapellati

Overview

Ethan Scapellati is a commercial litigator who focuses his practice on consumer class action defense, health care, education and matters arising from the False Claims Act. He has handled cases at all levels in state and federal courts, from pre-litigation strategy through trial and appellate briefing, and has managed teams of lawyers across multiple offices.

Ethan takes pride in strategizing directly with clients to achieve efficient litigation results. He is fluent in writing briefs, having drafted numerous successful dispositive and discovery motions as well as appellate briefs in state and federal courts. He is also well versed in leading complex document review projects, coordinating multidistrict litigation, and representing clients in mediation and settlement negotiations.

Prior to joining Stradley Ronon, Ethan worked as counsel for a global law firm in New York and as an associate at a law firm in Los Angeles. Before law school, Ethan was a U.S. Fulbright Fellow in Athens.

  • Represented a health insurer against actions in the U.S. District Court for the Southern District of New York and New Jersey state court concerning alleged underpayment of emergency room reimbursement claims; achieved partial dismissals of claims and discovery outcomes leading to favorable settlement positions.
  • Advised a plastic water bottle company in a false advertising class action in the U.S. District Court for the Northern District of California concerning the alleged falsity of the company’s recyclability labels and marketing.
  • Represented a pet food manufacturer in a false advertising and products liability class action MDL concerning excess ingredient levels in recalled pet food.
  • Counseled a creditor in enforcement action against a debtor on unpaid debt of $140 million in the Southern District of New York; achieved summary judgment, entry of judgment, and entitlement to enforce action against the debtor.
  • Advised a national health insurer in False Claims Act defense pertaining to alleged fraudulent data in Part D Medicare bids, leading to a favorable settlement outcome.

In The Community

Ethan maintains an active pro bono practice, ranging from achieving successful claims for clients seeking asylum and filing amicus briefs on constitutional issues before the U.S. Supreme Court and circuit courts of appeals. He also serves on the New York Advisory Board for Trust for Public Land (TPL), a national nonprofit that works to connect individuals to the benefits of the outdoors. Ethan has volunteered for TPL since 2019 and focuses his work on connecting corporate and individual stakeholders to the organization’s programming and fundraising while attending the organization’s various efforts in urban areas, such as schoolyard openings.
